We do not guarantee that the Site will always be operational or that any errors will be corrected.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AZURE BLUE, ITS OWNER(S), AGENTS, CONSULTANTS, AND LEGAL COUNSEL (INCLUDING BUT NOT LIMITED TO WARREN MORTEN AND THE MORTEN LAW GROUP, PC), SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

OUR TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED $100 USD, REGARDLESS OF THE CAUSE OF ACTION.

8. Indemnification

You agree to defend, indemnify, and hold harmless Azure Blue, its owners, employees, contractors, affiliates, and legal counsel from and against any claims, losses, damages, liabilities, and costs, including reasonable attorneys' fees, arising from:

Your breach of these Terms;
Your use or misuse of the Site;
Your violation of applicable laws or third-party rights.

9. Force Majeure

Azure Blue is not liable for any failure or delay in performance due to events beyond its reasonable control, including natural disasters, power outages, cyberattacks, labor shortages, or government actions.

10. Electronic Communications

By using the Site or contacting us via email, you consent to receive communications from us electronically, and you agree that such communications satisfy any legal requirement that communications be in writing.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California. All disputes arising out of or related to the Site shall be exclusively resolved in the state or federal courts located in Orange County, California. You expressly consent to personal jurisdiction and venue in those courts.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Updates to Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the new Terms.
